  2. you provide a sample/s of fluids and/or other substances your body produces directly to us or to your healthcare practitioner for testing purposes;
  3. enquiries or complaints are raised with us, or our distributor/s by you or on your behalf;
  4. you visit our premises;

  6. we conduct marketing and/or advertising campaigns for our products and/or services;
  7. people message us on social media;
  8. our staff visit you;
  9. you apply for a job with us;
  10. you provide goods and/or services to us;
  11. you interact with us in other ways;
  12. you pay us or receive payment from us.

If you do not provide your personal information to us, we may not be able to provide you with products or services or to respond to your enquiry.

Types of Personal Information Collected

Depending upon the reason for our interaction with you, we may collect different types of personal information from or about you. Examples of personal information we may collect include:

i) your name, address, telephone/mobile number, email address;

ii) your healthcare practitioner’s details;

iii) samples of fluids and/or substances your body produces;

iv) results of tests which you order from us, or your healthcare practitioner orders on your behalf from us;

v) recordings of your voice and/or appearance when you visit our premises and/or we communicate with each other;

vi) information regarding your use of our website and/or social media accounts;

vii) your credit card details;

viii) your work experience history when you apply for a job with us; and/or

ix) details about your healthcare practice.

This personal information is collected directly from you, or on your behalf from your healthcare practitioner, or from other relevant third parties such as our distributors, by direct communication, telephone, email, mail, personal delivery, via our website or from other publicly available sources.

We collect your personal information for the primary purpose of providing our goods and/or services to you. We may also use your personal information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

Consent To The Collection Of Sensitive Information

Certain personal information we collect is sensitive information such as your health information, the sample of body fluids or substances your body produces and/or the results of its testing. By providing us with this personal information or sample directly or indirectly via your healthcare practitioner you are consenting to our collection and use of such personal information.

Third Parties

Where reasonable and practicable to do so, we will collect your personal information only from you, your healthcare practitioner or others acting on your behalf. However, in some circumstances we may be provided with information by third parties such as distributors who sell our products and/or services. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your personal information (including sensitive information) may be disclosed to third parties who are acting for or on behalf of us or providing services to us.

Your personal information may also be disclosed:

  • to third parties where you consent to the use or disclosure; or
  • where required or authorised by law.

As the tests we provide are undertaken by or behalf of Diagnostic Solutions Laboratory LLC (DSL) located in the United States, personal information provided for testing purposes will be provided to DSL or their nominee in the United States. Results of testing will be collected by us and DSL and notified to you or your healthcare practitioner. All personal information (including sensitive information) collected or received by us is stored in local servers and backed up in the United States for security purposes.

By providing us, our distributors or your healthcare practitioner with your personal information for purposes related to our products and/or services you are consenting to the overseas transmission of your personal information.

PLEASE NOTE: By consenting to the overseas transmission of your personal information, you agree that we will not be held accountable under the Privacy Act (1988) Cth and you will not be able to seek redress under the Privacy Act (1988) Cth, if the overseas recipient does not handle your personal information in accordance with the Privacy Act (Cth).

Security of Personal Information

Your personal information is stored in a manner that reasonably protects it from misuse, interference and loss and from unauthorised access, modification or disclosure.

When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your personal information. However, most of the personal information is or will be stored by us in customer files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the personal information we hold about you and update and/or correct it, subject to certain exceptions. If you wish to access your personal information, please contact us in writing.

We will not charge any fee for your access request but may charge an administrative fee for providing a copy of your personal information.

In order to protect your personal information we may require identification from you before releasing the requested information.

It is an important to us that your personal information is up to date. We will take reasonable steps to make sure that your personal information is accurate, complete and up-to-date.
